This act amends and reenacts sections of the legislature in order to expand eligibility for extended foster care services.

RCW 74.13.336 is amended to include subsection (4), which specifies that DCYF shall provide extended foster care services to an 18 year old who:

  1. Is enrolled in a secondary education program or a secondary education equivalency program; and
  2. Establishes that one of his/her parents was not fulfilling their parental responsibilities before the youth reached age 18.
    1. DCYF is also authorized to develop criteria for establishing whether a parent was not fulfilling their parental responsibilities, which could include evidence that:
      1. The youth was homeless; or
      2. Not receiving proper nutrition.

The eligibility under this section does not require that a youth would have been dependent under RCW chapter 13.34.

RCW 74.13.031 is reenacted and amended by modifying subsection (11)(a)(vi) to include that DCYF shall provide continued extended foster care services to a nonminor dependent who is age 18 and:

  1. Enrolled in a secondary education program or a secondary education equivalency program; and
  2. Establishes that one of his or her parents was not fulfilling their parental responsibilities before the youth reached age 18 under RCW 74.13.336.
