SB 5477 requires that any substance intended for use in a vapor product that is sold at retail in WA State be packaged in child resistant packaging. If a manufacturer knowingly sells or distributes a substance intended for use in a vapor product that does not comply with the requirements of the law, they would be guilty of a misdemeanor. Additionally, the Board of Health is directed to adopt rules regulating the labeling and advertisement of vapor products. The rules must include a warning about the harmful effects of nicotine and a warning to keep the product away from children.

Commerce and Labor Committee Amendment: As amended, four additional components were added to the bill: (1) The definition of vapor product from the underlying bill was adopted into the prohibition of vapor product sales to minors; (2) Vapor products are prohibited from being used at schools; (3) Anyone who sells a vapor product at retail must display a sign concerning the prohibition of vapor product sales to minors; and (4) Vapor products must be stored behind the counter or in a locked case at a retail location.
