HB 2668 expands the ability for persons convicted of prostitution who committed the offense as a result of being a victim of trafficking, promoting prostitution in the first degree, promoting sexual abuse of a minor, or trafficking in persons under the Trafficking Victims Protection Act of 2000 to apply to a sentencing court for a vacation of their record of conviction of prostitution. Current law limits the ability for this vacation of convictions in the offender has committed another crime. HB 2668 would remove this stipulation in the event the offended could produce evidence the crimes were committed as a result of being a victim of prostitution, promoting prostitution in the first degree, promoting commercial sexual abuse of a minor, or trafficking person under the Trafficking Victims Protection Act of 2000.
