HB 2806: Concerning mediation in family law cases involving children

The purpose of mediation shall now be to assist parties to reach agreements on contested issues. Except for modifying a parenting plan or relocating, contested issues shall be scheduled for mediation. 

Each superior court shall establish a program and rules to provide for early mediation of cases involving issues relating to residential time or other matters governed by a parenting plan. Requirements for these rules are further outlined. 

Children may only be interviewed if both parents are in agreement that this necessary and appropriate. Any agreement reached shall be put into writing, signed by both parties, and submitted to the court.
