The guardianship process shall be amended to more effectively maintain the liberty and autonomy of all people in this state, including people with incapacities who have unique abilities or cannot exercise their rights or provide for their basic needs without the help of a guardian. An individual’s autonomy should only be restricted to the minimum extent necessary to adequately provide for their own health or safety, or to adequately manage their financial affairs. Technical aspects of this are outlined and definitions are added.
This bill makes modifications to the guardianship bill passed in 2019.
Amendment:
Delays the following until January 2022:
- The repeal of certain chapters
- Effective dates of the uniform guardianship, conservatorship, and other protective arrangements act
- Makes changes to the office of public guardianship and the uniform adult guardianship and protective proceedings jurisdiction act
- The effectiveness of supported decision-making agreement provisions in this bill
